1Introduction
At ProSculpt ("ProSculpt", "we", "us", "our") we value the privacy of our users and customers when they give us access to their Personal Data. This Privacy Policy describes how we work to maintain that trust and protect that information.
This Privacy Policy describes how we collect, use, store, protect and disclose Personal and Non-Personal Data when you access or use our online and/or mobile websites, applications, services and software, interact with us on the phone or in person, or (where permitted by applicable law and in line with this Privacy Policy) that we obtain from publicly available sources or third-party sources.
By using the Platform you agree to the collection and use of your information in accordance with this Privacy Policy. We handle your personal data responsibly and in compliance with applicable data-protection law.
2Important Definitions
"Internship/Job Seeker" is a user searching for training/employment openings, services, or information related to their personal training/employment or job search.
"Employer" is an individual and/or organization seeking information related to hiring or human resources, seeking job seekers, or seeking to make available information regarding employment openings, on their behalf or on others' behalf, including but not limited to agencies purchasing for multiple parties and employment agencies.
"Personal Data" is any data about an individual who is identifiable by or in relation to such data, and can include information about how you engage with our Services, such as device information or IP address.
"Job/Internship Listings" is a training/employment opening on ProSculpt.
"Resume" is a ProSculpt resume or a resume that you upload yourself.
3Collection of Information
We collect information about you and/or your usage to provide better services and offerings. We collect the following categories of Personal Information in the following ways:
3.1 Name, email address, password, country, city, contact number and company/organization that you are associated with when you sign up for alerts on the Platform;
3.2 Information that one would usually include in a resume, such as name, contact details (including e-mail address and mobile number), work experience, educational qualifications, data relating to your current and past remuneration or salary, a copy of your resume, etc., when you register on the Platform;
3.3 Information about the services that you use and how you use them, including log information and location information, when you are a user of the services through the Platform;
3.4 Personal Information such as name, age, contact details, preferences, etc., through surveys and forms when you choose to participate;
3.5 When you use a device to access the Platform, we may collect technical or other related information from the device as well as the device location;
3.6 To the extent permitted by law, we may record and monitor your communications with us to ensure compliance with our legal and regulatory obligations and internal policies, which may include the recording of telephone conversations;
3.7 When you sign in with your social media account or otherwise connect it to our services, you consent to our collection, storage and use (in accordance with this Privacy Policy) of the information you make available through that interface. Please review your social media provider's privacy policy for how they share information.
4Your Consent
We process your Personal Data only for lawful purposes and, where required, on the basis of your free, specific, informed and unambiguous consent, signified by a clear affirmative action. At the point of collection (for example, at sign-up and before payment) we present a clear notice describing what data we collect, the specific purpose, and how you can exercise your rights or raise a grievance.
Where we process data without consent, we do so only for legitimate purposes permitted by law (for example, to provide a service you requested, to comply with a legal obligation, or to respond to an emergency).
5Use of the Information
The use of your data depends on the purpose for which you interact with us. We may process your Personal Information to:
5.1 Protect our users and provide you with customer support;
5.2 Provide our services and products, including job alerts, calendar alerts, relevant search results, recommended jobs and/or candidates, and other communication facilities;
5.3 Use information collected from cookies and similar technologies to improve your experience and the overall quality and features of our services;
5.4 Conduct market research and surveys to improve our products and services;
5.5 Establish, exercise or defend legal rights in connection with legal proceedings (including prospective proceedings) and obtain professional or legal advice;
5.6 Send you information about our products and services for marketing and promotions (you may opt out at any time);
5.7 Prevent, detect, investigate and act against fraud, financial crimes, other illegal activities, suspected fraud, or violations of our Terms of Use in any jurisdiction;
5.8 Carry out identity verification, government sanctions screening and due-diligence checks to the extent required.
6Your Rights & Choices
You have the following rights, which you may exercise from your account settings or by contacting us:
6.1 Access: obtain a summary of the Personal Data we hold about you and how we process it;
6.2 Correction and updating: correct inaccurate or misleading data and complete or update your data; you can edit your account profile and resume at any time;
6.3 Deletion: request deletion of your Personal Data; you can request account deletion from your settings (see Section 7), following which we will delete or de-identify your data subject to legal retention requirements;
6.4 Grievance redressal: a readily available means to raise grievances (Section 15);
6.5 Nomination: nominate another individual to exercise your rights in the event of your death or incapacity.
7Retention & Erasure of Information
We retain your Personal Data only for as long as it is necessary for the purposes for which it was collected, or as required to comply with applicable law. You can correct or update your account profile and resume at any time, and you may delete your account at any time from your account settings.
Where you have not used your account or interacted with us for a continuous period of three (3) years, we may erase (or de-identify) your Personal Data, except where retention is required by law. Before doing so, we will give you advance notice so you may choose to keep your account.
On account deletion or erasure, we will delete or irreversibly de-identify your Personal Data, and will instruct our service providers to do the same, except for data we are legally required to retain.
8Sharing of Information
8.1 If you are an Employer, information related to your internship and/or job post (organisation name, URL, description, job description, skills required, etc.) is published online and can be viewed by anyone visiting ProSculpt. This information may also appear on search engines like Google. We may share your contact details with students who apply to your internships/jobs or get hired by you through ProSculpt.
8.2 If you are an Applicant, we may share your Personal Information with Employers whose internships/jobs you apply to, or who we believe are relevant to you, or who come across your profile through a search of our user base.
8.3 We may share your information with third-party individuals, contractors, companies and other service providers ("Data Processors") that perform services on our behalf or in partnership with us, under contracts that require them to protect your data and process it only on our instructions.
8.4 You may have the option to share your information and activity through social media. We do not control information shared with third-party social networks; review their policies before consenting.
8.5 If you post Personal Information in public areas of ProSculpt (forums, chat, comments), it will be accessible to everyone on the public internet and may be collected and used by others over whom we have no control.
8.6 When we send you an e-mail or SMS, we use a third-party service and therefore pass on your e-mail address/mobile number to that provider. We only work with reputed providers, but are not responsible for their use of this information.
8.7 We reserve the right to publish job/internship posts on social media platforms, third-party websites, newspapers and magazines to increase the visibility of the post.
8.8 We may share your information to investigate, prevent or act on possible illegal activities, to comply with legal process, or to enforce this Policy and our Terms, including with law enforcement, government agencies and courts.
9Third-Party Content
9.1 Our Platform sometimes contains links to other sites that are not governed by this Privacy Policy (advertisers, blogs, content sponsorships, vendor services, social networks, etc.).
9.2 We make no representations regarding how your information is stored or used on third-party servers. We recommend you review the privacy statements of each third-party site linked from ProSculpt.
10Children & Persons with Disability
ProSculpt is intended for users aged 18 and above. Where we process the Personal Data of a child (any individual under 18 years) or a person with disability who has a lawful guardian, we will obtain verifiable consent of the parent / lawful guardian.
We do not undertake tracking, behavioural monitoring or targeted advertising directed at children, and we will not process children's data in a way likely to cause any detrimental effect on their well-being.
11Cookies and Pixel Tags
ProSculpt and third parties with whom we partner may use cookies, web beacons and pixel tags to collect information about your use of ProSculpt and third-party websites. A cookie is a small text file stored on your device that lets us remember you and your actions, helping us remember preferences and searches, keep you logged in, customise content, perform analytics, and assist with security and administrative functions. Cookies may be persistent or session-only. A pixel tag is a tiny graphic with a unique identifier embedded invisibly in an e-mail, used to track whether the e-mail has been opened and for other analytics. 12Security Safeguards
We maintain reasonable technical and organisational security measures designed to protect your Personal Data against loss, misuse, alteration or unauthorised access, including encryption in transit and at rest, access controls and least-privilege access, disaster-recovery and backup processes, continuous monitoring, and regular vulnerability assessments of our systems and networks. We retain relevant access and security logs for a reasonable period.
However, no method of transmission or electronic storage over the Internet can be 100% secure. We assume no liability for disclosure of your information due to causes beyond our reasonable control.
13Data Breach
In the event of a data breach, we will take prompt action to mitigate it and will notify affected users without undue delay (describing the nature of the breach, its likely consequences, the measures we have taken, and any steps you can take), and notify the relevant authorities where required by law.
14Changes & Disclaimer
14.1 We may make changes to this Policy from time to time. You are advised to refer to this page to know our latest Privacy Policy.
14.2 We do not store any bank-account information or any credit/debit card details. We shall not be liable for any loss or damage sustained as a result of any disclosure of information concerning your bank account, credit or debit cards during online transactions or payments made for products/services offered through the Platform.
14.3 While this Policy states our standards for data maintenance and we will make efforts to meet them, factors beyond our control may result in disclosure of data; accordingly we disclaim warranties relating to the maintenance or non-disclosure of data, to the extent permitted by law.
